Agreement to Terms

By accessing and using Boric Car Rental's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service constitute the entire agreement between you and Boric Car Rental and govern your use of our services, superseding any prior agreements.

Rental Requirements

Driver Requirements

  • Minimum Age: 23 years old for most vehicle categories
  • Valid License: Must possess a valid physical driver's license (held for at least 1 year). Digital or photocopied licenses are not accepted at pickup
  • International Drivers: International Driving Permit required for non-local licenses
  • Additional Drivers: Must meet the same requirements and be registered at pickup
  • License Verification: We reserve the right to verify license validity

Booking Requirements

  • Advance Booking: Recommended 24-48 hours in advance, especially for peak periods
  • Payment: Full payment required at time of booking for most reservations
  • Confirmation: All bookings must be confirmed via email or SMS
  • Modifications: Changes to reservations must be made at least 24 hours in advance

Insurance Coverage

Included Coverage

All rentals include basic third-party liability insurance as required by Curaçao law. This covers:

  • Damage to other vehicles or property
  • Injury to third parties
  • Legal defense costs up to policy limits
  • Basic roadside assistance

Optional Coverage

Additional coverage options available at pickup:

  • Collision Damage Waiver (CDW): Reduces financial responsibility for vehicle damage
  • Theft Protection (TP): Coverage for vehicle theft
  • Personal Accident Insurance (PAI): Medical coverage for driver and passengers
  • Supplemental Liability Insurance (SLI): Additional third-party liability coverage

Important Insurance Note

Insurance does not cover: Damage due to off-road driving, driving under the influence, willful damage, or damage to tires/windshield (unless additional coverage purchased). Personal belongings are not covered.

Vehicle Use and Restrictions

Permitted Use

  • Personal use only (no commercial activities)
  • Driving on paved roads only (no off-road driving)
  • Maximum of registered drivers only
  • Transport of personal belongings only
  • Use within Curaçao territorial limits

Prohibited Activities

  • Driving under the influence of alcohol or drugs
  • Off-road driving or beach driving
  • Towing or pushing other vehicles
  • Racing or speed contests
  • Transport of hazardous materials
  • Use by unauthorized drivers
  • Smoking in vehicles

Pricing and Payment

Rental Rates

Our rates include:

  • Base rental rate for the vehicle category
  • Basic insurance coverage
  • Unlimited kilometers (for most categories)
  • Airport surcharge if applicable
  • Local taxes and fees

Additional Charges

  • Additional Driver: $10-15 per day per additional driver
  • Child Seats: $8-12 per day
  • GPS Navigation: $10-15 per day
  • Fuel: Charged for missing fuel upon return
  • Late Return: Full day charges for returns more than 2 hours late
  • Cleaning Fee: $50-100 for excessive dirt or smoking

Cancellation and Modification Policy

Cancellation

  • Free Cancellation: Up to 48 hours before pickup for standard rates
  • Partial Refund: 24-48 hours before pickup (50% charge)
  • No Refund: Less than 24 hours before pickup or no-show
  • Peak Season: Special cancellation terms apply during holidays

Modifications

  • Vehicle changes subject to availability and rate differences
  • Date/time changes must be made at least 24 hours in advance
  • Location changes may incur additional fees
  • Extension requests subject to vehicle availability

Vehicle Condition and Maintenance

Pickup Inspection

All vehicles are inspected before rental. You must:

  • Inspect the vehicle with our staff at pickup
  • Report any existing damage immediately
  • Note fuel level and odometer reading
  • Verify all accessories are present and working

During Rental

  • Maintain proper fluid levels (oil, coolant, etc.)
  • Monitor dashboard warning lights
  • Return vehicle with same fuel level
  • Report accidents or mechanical issues immediately

Return Requirements

  • Return on time to avoid late fees
  • Return with same fuel level or pay refueling charges
  • Report any new damage to staff immediately
  • Remove all personal belongings

Liability and Damages

Customer Responsibility

As the renter, you are responsible for:

  • All traffic violations and parking tickets
  • Damage to vehicle not covered by insurance
  • Theft or loss of vehicle if not properly secured
  • Damage caused by unauthorized drivers
  • Damage from prohibited activities

Damage Assessment

  • All damage is assessed by qualified mechanics
  • Repair costs are calculated using manufacturer rates
  • Administrative fees may apply for damage processing
  • Third-party damage claims are handled separately

Important Liability Notice

Without additional insurance coverage, you may be responsible for the full value of the vehicle in case of damage or theft.

We strongly recommend purchasing comprehensive insurance coverage for peace of mind during your rental.

Accident and Emergency Procedures

In Case of Accident

  1. Ensure Safety: Check for injuries and move to safe location
  2. Contact Authorities: Call police (+5999 222 2222) for all accidents
  3. Contact Us: Call our 24/7 emergency line immediately
  4. Document: Take photos and gather witness information
  5. Do Not Leave: Wait for police to arrive before moving vehicle

Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of Curaçao. Any disputes arising from this agreement shall be resolved through:

  1. Mediation: We encourage amicable resolution through mediation
  2. Courts of Curaçao: Exclusive jurisdiction for all disputes
  3. Arbitration: Optional binding arbitration for commercial disputes

You agree to submit to the jurisdiction of the courts of Curaçao for any legal proceedings arising from this agreement.
